   My name is Yuriy. I am a citizen. I live in Brooklyn from 1992. I am divorsed and my gross income is $28,000.00 a year. My parents(father 64 years old and mother 63) come to NY one month ago with status emmigrant. My parents live with me. My father just started to work and his salary is $219.00 per week after taxes. My qiestions are: 1.Can they applay for medicaid or any other medical insurance because I can not provide medical insurance for them? What I have to do? 2. When they will be able to applay for SSI or any public assistance if they will not able to work? 3.If they rent thier own appartment can they applay for food stemps? His salary will not be enoph to support themself.

   Ok, first a few things for you to know: that was a REALLY STUPID idea to let your Father work! Now it will be extremely difficult for them to get a housing and they can forget about Medicaid at all, while being 64/63 they could easily get it, if your Father would NOT work!!! Back to your questions: Your Father's salary (as well as everybody else!) counts BEFORE taxes, not AFTER! It means, he has a pretty good salary for two (around $1200 a month) and a $300 a week is MORE than they can have, if they would like to apply for Medicaid (income should be NO MORE than $950 a month to be eligible)! They can try to apply for Free Care at any participating hospitals in heir are of residence. They most likely will get it. Second, your parents are NOT eligible for any federal help such as welfare or SSI. You singed an I-864 Affidavit of Support for them where you promise to support them, remember? Read what this form saying about becoming a public charge! The government can sue you and deport your parents back to the country they came from! Your parents can apply for housing, but now since they have an income, they have to pay more (1/3 of their income). Food stamps, -- beginning 2002 you are included in your parents household for food stamp purposes, so your combined income is MUCH higher than it needed. You parents have to rent their own apartment (or they can live with you, but you still have to do a rent agreement for them), if they want to apply for a subsidal housing. Otherwise, they can't even get that! You have to show on your bank statement that you loan your parents money every month. So, now you can see how many mistakes you did and what you and your parents can hope for. I have exactly the same situation, only my parents a little bit older and understand you very well, but unfortunately nothing I can do till they become a US Citizens with only exception that we can and will apply for Medicaid and housing that will costs them practically nothing since they don't have an income rather just borrowing money from me each month. Sorry for my language, but if you don't know what to do, you should ask first!
